Shiatsu in Hungary

1.  LEGAL FRAMEWORK FOR SHIATSU

There are two separate ways to practice Shiatsu in Hungary. Most of the practitioners choose the wellness route.

A) The Healthcare Route: AMMT (TEÁOR 8699)

Under this model, Shiatsu is classified as an official medical/complementary healing intervention under the Alternative Movement and Massage Therapy vocational branch, legally operating under TEÁOR 8699 (Other human health / alternative medicine activities).

  • The Educational Track: Practitioners must complete long-term accredited studies and pass the rigorous state healthcare board examination under National Hospital Directorate (OKFŐ).
  • The Clinical Setting: Because this path involves practicing a state-recognized healing art, operations are strictly bound by healthcare regulations. The practice must pass a Government Office / Public Health inspection, establish a dedicated treatment space equipped with medical taps/sinks, and register with the national healthcare registry.
  • Professional Rights: This is the only pathway where it is legally permitted to use the titles Shiatsu Therapist or Practitioner (Shiatsu-gyógyász / Shiatsu terapeuta). Only under this framework is it legal to advertise the treatment of chronic pain, asthma, digestive issues, or orthopedic conditions, as well as to accept formal referrals from medical doctors.
  • Maintenance: Practitioners are required to continuously collect health sector credit points every 5 years to keep the professional license active.

B) The Wellness Route: Physical Well-Being (TEÁOR 9623)

Under this model, Shiatsu is legally stripped of its medical context and is provided purely as a commercial stress-relief and relaxation service under TEÁOR 9623 (Physical Well-Being Improvement)

  • The Educational Track: Legally, no official state-backed qualification is mandated to open the business. Many start as a sole trader (Egyéni Vállalkozó) after taking brief certificate courses.
  • The Studio Setting: Bypasses healthcare licensing entirely. No ÁNTSZ health department pre-inspections are required to issue the commercial operational permit, meaning the strict "medical sink" and specific partition rules do not apply.
  • The Marketing and Invoicing Boundaries: This is where practitioners must be incredibly cautious. You cannot use words like "therapy," "healing," "treatment," or "cure" in marketing materials or invoices. The invoice must state physical well being improvement.
  • The Practice Scope: The service must be promoted strictly as stress relief, relaxation, harmonizing life-energy, or general body conditioning.

 

 1.1   Is Shiatsu explicitly defined or recognised in national law?

Shiatsu is explicitly listed as a mandatory core subject and testing element under Decree No. 11/1997. (V. 28.) NM issued by the Ministry of Welfare (Népjóléti Minisztérium).

This means that by Hungarian law, Shiatsu is a non-negotiable part of the official healthcare curriculum. To get licensed as an Alternative Movement and Massage Therapist, you are legally required to study Shiatsu and pass a state exam on it.

  • The law groups it under the umbrella of Alternative Movement and Massage Therapy (AMMT).
  • The Legal Text: In the official curriculum annex of the law, Shiatsu is explicitly named alongside Yumeiho and Do-In as the specific modalities that a candidate must master, combine, and perform during the state-administered practical healthcare exam.

1.2   How is Shiatsu classified legally?

Under Hungarian national law, Shiatsu is legally classified as a non-physician complementary medical activity (natural medicine) within the vocational branch of Alternative Movement and Massage Therapy (Alternatív mozgás- és masszázsterápia).

Its regulatory status is defined by the following official parameters:

  • Primary Statutory Framework: It is governed under Government Decree No. 40/1997. (III. 5.) Korm. and Welfare Ministry Decree No. 11/1997. (V. 28.) NM, which explicitly list Shiatsu as a mandatory core subject and testing element required to obtain a state healthcare license.

This path requires passing the state exam administered by the National Hospital Directorate (OKFŐ), registering in the National Healthcare Registry, and obtaining a public health operational permit from the local Government Office (Kormányhivatal).

 

1.3   Who may practise Shiatsu?

A) AMMT

Therapeutic or Medical Practice (Healthcare Pathway)

To legally perform Shiatsu as a therapy, healing modality, or to treat medical symptoms, a person must fulfill the stringent requirements of Welfare Ministry Decree No. 11/1997. (V. 28.) NM. Under this framework, only the following licensed individuals may practice:

  • Licensed Alternative Movement and Massage Therapists (AMMT): Individuals who have completed state-accredited training, passed the formal National Hospital Directorate (OKFŐ) natural medicine exams, and hold an active registration in the National Healthcare Registry.
  • Prerequisites for AMMT licensure include holding a high school diploma, passing standalone Medical and Natural Health basic training modules, and completing mandatory clinical internships (such as spending weeks shadowing in a Traditional Chinese Medicine clinic or physiotherapy practice)

B) Physical Well-Being Improvement

 Relaxation or Stress-Relief Practice (Wellness Pathway)

To legally perform Shiatsu purely as a commercial stress-relief or body-conditioning service, the threshold is significantly lower

  • Registered Business Owners / Employees: Under Hungarian vocational deregulation laws, anyone who holds a basic private adult education training certificate (Tanúsítvány) may legally set up as a sole trader (Egyéni Vállalkozó) or work in a massage salon to offer the physical techniques of Shiatsu.
  • Restrictions: These practitioners are strictly prohibited from utilizing medical terminology, issuing medical diagnoses, treating injuries, or calling themselves "therapists" or "healers". They must market and invoice their services purely as general physical well-being improvement or refreshing massage.

1.4   What activities may Shiatsu practitioners perform?

A) AMMT

Licensed AMMT Therapists

Practitioners registered under TEÁOR 8699 with an OKFŐ health license can legally perform full, clinical complementary treatments:

  • Energetic and Structural Assessment
  • Treat specific, documented medical conditions, chronic pain, sports injuries, psychosomatic disorders, or stress-related illnesses.
  • Combine Shiatsu with other elements tested in their state exam, such as Do-In (self-massage and corrective movements) and Yumeiho therapy.
  • Maintain official client histories, medical records, and explicitly use terms like "therapy," "healing," "rehabilitation," and "treatment" on invoices and websites.

 

B) Physical Well-Being Improvement

Physical Well-Being Providers

  • Practitioners registered as standard business owners under TEÁOR 9623 can legally perform the physical techniques of Shiatsu, but only within a non-medical scope
  • Relaxation and Body Conditioning: Apply the physical finger pressure, palm pressure, and gentle stretches characteristic of Shiatsu to alleviate general physical fatigue, induce deep relaxation, and relieve everyday muscle tension.
  • Energy Harmonization: Promote the service as a way to balance life energy, boost general vitality, and improve overall well-being.
  • Restrictions: They cannot perform diagnostic assessments, claim to heal or cure any illness, treat injuries, or accept medical referrals. Every activity must be framed, marketed, and invoiced strictly as a refreshing/wellness service.

 

1.5   What activities are they prohibited from performing?

Based on the Hungarian Criminal Code (Btk.) and primary healthcare legislation (Decree No. 11/1997. (V. 28.) NM), Shiatsu practitioners are strictly prohibited from performing any activities that infringe upon regulated medical or diagnostic boundaries.

The prohibited activities include:

  • Establishing Western Medical Diagnoses: Practitioners cannot issue formal medical diagnoses, identify clinical pathology, or analyze laboratory test results. Under Section 187 of Act C of 2012 on the Criminal Code (Btk.), practicing unauthorized medical acts for compensation or on a regular basis is classified as illegal medical practice (kuruzslás), which carries a criminal penalty of up to 1 year in prison.
  • Modifying Doctor-Prescribed Treatments: Practitioners cannot alter, cancel, or intervene in medical treatments, pharmacological prescriptions, or therapeutic instructions issued by a licensed physician.
  • Performing Invading or Specialized Medical Interventions: They cannot perform invasive medical procedures, prescribe prescription-only medications, use clinical medical equipment, or perform targeted physical therapies reserved strictly for licensed medical doctors, dermatologists, or physiotherapists
  • Treating Counterindicated Conditions (Without Prior MD Authorization): They cannot provide physical manipulation or pressure-based treatments if the client suffers from acute medical counterindications. According to health and safety regulations, this includes acute inflammation, high fever, active bleeding disorders, open wounds, infectious skin diseases, or unmanaged fractures.
  • Using Unlawful Medical Claims in Marketing: Under consumer protection and healthcare naming laws, practitioners registered under the wellness pathway (TEÁOR 9623) cannot use therapeutic language. They are legally barred from using terms like "therapy" (terápia), "healing" (gyógyítás), or "clinical treatment" on invoices, websites, or promotional materials

 

1.6   Are there statutory minimum requirements?

A) AMMT

  • AMMT The Exams: You must pass three separate exams administered by the National Hospital Directorate (OKFŐ): the General Medical Module, the General Natural Health Module, and the AMMT Practical/Theoretical Specialization Exam.
  • Clinical Internships: Under the NM decree, the candidate must complete mandatory practical clinical stages:
    • 2 weeks in a medical-natural health clinic (orvos-természetgyógyászati rendelő).
    • 1 week in a Traditional Chinese Medicine or acupuncture clinic.
    • 2 weeks shadowing a certified physiotherapist (gyógytornász).
  • Valid Professional Liability Insurance policy (felelősségbiztosítás), join the National Healthcare Registry, and fulfill mandatory administration.
  • Mandatory membership in the Hungarian Chamber of Healthcare Professionals (MESZK)

For voluntary certification, the Hungarian Shiatsu Association requires, among other things a minimum of 500 contact hours, 200 registered treatments as practical evidence and follows the ESF guidelines for examinations and curriculum.

 

1.7   Is registration, authorisation or a licence required?

The Basic Registry (Alapnyilvántartás): Once you pass your state natural medicine exams, the National Hospital Directorate (OKFŐ) automatically enters your qualification into the national healthcare professional baseline registry.

1.8   Which authority is responsible?

National Hospital Directorate (Országos Kórházi Főigazgatóság OKFŐ)

This is the primary national authority. The OKFŐ is responsible for organizing the state natural health exams, issuing your individual professional diploma, maintaining the mandatory Basic and Operational Registry (Egészségügyi Szakdolgozók Alap- és Működési Nyilvántartása), and tracking your mandatory 5-year continuing education credit points.

The County/Budapest Government Office Public Health Department ( Kormányhivatal Népegészségügyi Főosztálya)

This local authority handles structural compliance. They inspect your physical workspace and issue the official premises operational permit (működési engedély) to verify that your clinic complies with health, room-size, and medical-tap hygiene laws.

1.9   Is the professional title protected?

No, the specific title of "Shiatsu Practitioner" or "Shiatsu Therapist" is not a standalone legally protected professional title in Hungary. Anyone can legally practice or offer services under the general name "Shiatsu" without a specialized government-issued license for that specific word.

 

1.10   Are there restrictions regarding advertising or claims of healing?

Yes, there are strict restrictions. In Hungary, advertising laws and consumer protection regulations heavily restrict health-related claims, especially for non-medical or alternative practices like Shiatsu.

Under Hungarian law, only officially registered medicines and certified medical treatments can claim to "cure," "heal," or "treat" a human disease

According to the Hungarian Code of Advertising Ethics, if a service or product is not an official medical therapy, its marketing must not mimic a medical service. 

2.  ADMINISTRATIVE REQUIREMENTS FOR THE PRACTICE OF SHIATSU

2.1   Must a trade, liberal profession or other form of self-employment be registered in order to practise Shiatsu?

TEÁOR 9623 (Wellness / Physical Well-being):

  • Wellness and relaxation massages are subject to the standard 27% VAT.
  • Most sole proprietors bypass this by choosing Alanyi Adómentesség (AAM), which grants a tax-free VAT status as long as your total annual business revenue stays under HUF 12 million.

 

2.4   Are Shiatsu services subject to VAT or exempt from VAT under certain conditions?

Under Section 85 (1) c) of the Hungarian VAT Act (Áfa törvény), human healthcare services—explicitly including natural medicine (természetgyógyászat)—are exempt from VAT by their very nature.

However, you can completely bypass paying VAT by choosing Alanyi Adómentesség (AAM) when registering your business.

  • Formal health documentation laws strictly apply. Practicing under this path requires maintaining structured patient medical histories, precise intake assessments, and ongoing progress notes, which must be archived safely for a mandatory statutory period (typically 30 years).

B) Physical Well-Being Improvement

  • There is no legal mandate to record medical histories. A basic appointment log or generic customer notes are sufficient.

Data Protection (GDPR)

A) AMMT

  • This path involves processing "Special Category" health data under GDPR Article 9. This demands the highest level of security, including explicit written data-processing consent, keeping medical notes separate from standard client names, and using encrypted or locked storage.

B)-Physical Well-Being Improvement

  • Wellness Path (Physical Well-being): This involves handling basic personal data (names and contact details). A standard GDPR Privacy Notice (Adatkezelési Tájékoztató) must be available on the wall or website, but the security threshold is less complex.

 

2.8   Are there special rules for the treatment of minors or other vulnerable persons?

 

Treatment of Minors (Under Age 18)

  • Legal Consent: Minors cannot legally provide exclusive consent for treatment. For children under 14 years old, a parent or legal guardian must sign the consent and privacy forms. For minors aged 14–18, both the minor and the parent must provide consent.
  • Chaperone Requirement:

Best practice and clinical guidelines dictate that a parent or legal guardian must be present in the treatment room during Shiatsu sessions for minors to prevent any liability or ethical issues.

  • Healthcare Path vs. Wellness: On the healthcare path (AMM), the parental consent becomes a permanent part of the statutory medical documentation.

Treatment of Vulnerable Persons (Elderly, Disabled, or Incapacitated Individuals)

3. PROFESSIONAL ASSOCIATIONS AND PROFESSIONAL STANDARDS

3.1   Which national Shiatsu professional associations or relevant umbrella organisations exist?

The national professional association is the Hungarian Shiatsu Association (Mashite)

Hungarian Integrative Medicine Alliance (MIMSZ) acts as the national umbrella organization that connects and advocates for various complementary, natural, and integrative medicine professional groups in front of healthcare decision-makers.

 

3.2   Which training and practice standards must practitioners meet in order to be recognised, accredited or certified by the relevant professional association?

To become part of the public register it is requiered.

3.12   What legal or practical significance does association certification have in the country concerned?

MASHITE does not issue a certification that is a state professional licence. It serves as a voluntary quality-assurance mechanism by documenting professional training standards, insurance, adherence to ethical requirements  and the MASHITE public register allows members of the public to identify certified practitioners who meet the association’s standards.

 

4. PRACTICAL SETTINGS FOR SHIATSU PRACTICE

4.1   In which settings is Shiatsu commonly offered, for example in private practice, health centres, clinics, care facilities, companies or wellness establishments?

Private Practices / Studios: The most common setting. Certified practitioners operate their own specialized bodywork studios or rent private therapy rooms.

Health Centres: Shiatsu is also offered alongside other natural and complementary therapies.

Corporate Wellness Programs: Few companies hire Shiatsu practitioners to provide on-site treatments—often modified as short, clothed chair-massage sessions—to reduce employee stress, prevent burnout, and alleviate desk-related posture issues

 

4.2   Is a medical referral, prescription or collaboration with a healthcare professional required for certain applications?

A) AMMT

Yes, a medical background is legally required. Under Hungarian law (Government Decree 40/1997), non-medical licensed naturopaths, including AMM therapists practicing Shiatsu, cannot diagnose illnesses or establish primary medical treatment plans independently [jogtar.hu].

  • Prevention Exemption: Formal medical referrals or specific doctor consultations are not required when the application is limited strictly to wellness, relaxation, or general preventative healthcare.

 

4.3   May Shiatsu be offered as a complement to medical treatment?

Yes, it can be legally offered as a complementary therapy in Hungary.

However, to use the words "complementary therapy”, or to treat medical conditions legally, the practitioner must hold the official state healthcare license (AMM – Alternatív mozgás- és masszázsterapeuta) registered under TEÁOR 8699.

4.4   Are there special rules for collaboration with doctors, physiotherapists or other healthcare professionals?

In Hungary, there is no specific, separate law regulating how a Shiatsu practitioner must collaborate with doctors or physiotherapists..

4.5   Are foreign Shiatsu training programmes or certificates recognised?

MASHITE accepts the diplomas of practitioners who were examined by schools that are members of national associations affiliated with the European Shiatsu Federation (ESF).

4.6   What additional requirements apply to practitioners who completed their training in another country?

No additional requierements.
